These Terms of Service (“Terms”) govern your access to and use of the website at lumisstudios.site (the “Site”), operated by Lumis Studios (“Lumis Studios”, “we”, “us”, or “our”), a software studio based in Nairobi, Kenya. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with them, please do not use the Site.

The Site is an informational and marketing website that describes Lumis Studios, our services, and our past work. The content on the Site is provided for general information only. Nothing on the Site constitutes a binding offer, a quote, or professional advice, and it does not create a client relationship on its own.

You agree to use the Site lawfully and not to:

• Use the Site in any way that breaches applicable laws or regulations.
• Attempt to gain unauthorised access to the Site, its servers, or any connected systems.
• Interfere with, disrupt, or place an unreasonable load on the Site or its infrastructure.
• Use any automated means to scrape, copy, or harvest content except as permitted by our robots directives.
• Submit false information, spam, or malicious content through the contact form.

Unless otherwise stated, all content on the Site — including text, design, graphics, the Lumis Studios name and logo, and the arrangement of case studies — is owned by Lumis Studios or its licensors and is protected by applicable intellectual-property laws.

Project names, trademarks, and brands of clients or third parties shown on the Site (for example in case studies) remain the property of their respective owners and are used for identification and portfolio purposes only.

You may view and share links to the Site for personal or internal business use, but you may not copy, reproduce, republish, or commercially exploit any content without our prior written permission.

Any project, consulting, or development work we carry out for you is governed by a separate written agreement (such as a proposal, statement of work, or service contract) entered into between you and Lumis Studios. Where there is any conflict between these Terms and that separate agreement, the separate agreement prevails in respect of the work it covers.

Information on the Site about our services, response times, and process is indicative and does not constitute a contractual commitment until set out in such a signed agreement.

The Site may link to third-party websites — including live versions of projects we have built and our social profiles. We do not control those sites and are not responsible for their content, availability, or practices. A link does not imply our endorsement, and your use of any third-party site is at your own risk and subject to that site’s own terms.

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations that the Site will be uninterrupted, error-free, secure, or that the information it contains is accurate, complete, or current. Any reliance you place on the content is at your own risk.

To the fullest extent permitted by law, Lumis Studios will not be liable for any indirect, incidental, special, or consequential loss or damage, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of — or inability to use — the Site. Your use of the Site is also governed by our Privacy Policy, which explains how we collect and handle personal data. By using the Site, you acknowledge that you have read and understood it.

We may revise these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page, and the revised Terms take effect once posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, and any disputes arising out of or in connection with them are subject to the exclusive jurisdiction of the courts of Kenya.
